Terms of Service

Welcome to The Bunker. These Terms of Service ("Terms") govern your access to and use of The Bunker mobile application, website, and related services (the "Service") provided by The Bunker ("we", "us", or "our"). By downloading, accessing, or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Who May Use the Service

  • You must be at least 13 years old to use the Service. If you are between 13 and the age of majority in your jurisdiction, you may only use the Service with the permission of a parent or legal guardian.
  • You represent and warrant that you are legally eligible to form a binding contract with us and are not barred from using the Service under applicable law.

2. Accounts and Security

  • To access certain features you must create an account (an "Account") and provide accurate, current, and complete information.
  • You are responsible for maintaining the confidentiality of your Account credentials and for all activity that occurs under your Account.
  • You must notify us immediately at support@bunker-bros.com if you learn of or suspect any unauthorized use of your Account.

3. Authentication and Identity Verification (including ID.me)

  • Some features of the Service may require identity verification. We may use third-party identity verification providers (for example, ID.me) and authentication systems (for example, Firebase Authentication) to confirm your identity and eligibility for particular features.
  • By using features that require verification, you authorize us to share the minimum information required with the third-party verifier and to receive verification results.
  • We do not control the verification process conducted by third parties. You should review the verifier's terms of service and privacy policy before completing verification.
  • We will retain verification results only as described in our Privacy Policy and process them in accordance with applicable law.
  • If you decline, fail, or revoke verification, access to certain features may be limited or denied.

4. Privacy

  • Our collection, use, and disclosure of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy explains what personal data we collect, how we use it, who we share it with (including identity providers), and your choices.

5. User Content and Licenses

  • "User Content" means any content you submit, post, or display using the Service (text, images, audio, video, links, or other materials).
  • You retain ownership of your User Content. By posting User Content you grant The Bunker a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, reproduce, modify, publish, translate, distribute, and display that content in connection with operating, promoting, and improving the Service.
  • You represent and warrant that you have all necessary rights in the User Content and that posting it does not violate these Terms or any applicable law.

6. Prohibited Conduct

You agree not to:

  • Post or transmit content that is unlawful, defamatory, pornographic, violent, harassing, hateful, or that promotes illegal activity.
  • Impersonate any person or organization or falsely state or misrepresent your affiliation with a person or organization.
  • Stalk, bully, threaten, or invade the privacy of others.
  • Use the Service to solicit business, send spam, or otherwise engage in commercial messaging without our prior written permission.
  • Access, tamper with, or use non-public areas of the Service except as permitted by us.
  • Attempt to probe, scan, or test the vulnerability of any system of The Bunker or breach any security or authentication measures.

7. Moderation, Removal, and Termination

  • We may review, remove, or refuse to publish any User Content that violates these Terms or that we reasonably determine to be inappropriate.
  • We may suspend or terminate Accounts or access to the Service for violation of these Terms or for any other reason at our discretion.
  • If we remove content or terminate your Account, we will provide notice unless doing so is impractical, unlawful, or would compromise an investigation.

8. Intellectual Property

  • The Service and its original content, features, and functionality are and will remain the exclusive property of The Bunker and its licensors.
  • If you believe your intellectual property rights have been infringed on the Service, please contact us and follow the process described in our DMCA policy.

9. Links and Third-Party Services

  • The Service may contain links to third-party websites or services not owned or controlled by us. We are not responsible for the content, security, or practices of those third parties.
  • Your interactions with third-party services (including identity verifiers such as ID.me) are solely between you and the third party.

10. Disclaimers

  • THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
  • WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of Liability

  • TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE BUNKER, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
  • OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES ARISING OUT OF OR RELATED TO THESE TERMS SHALL NOT EXCEED $100 USD OR THE AMOUNT YOU PAID US IN THE LAST 12 MONTHS, IF ANY.

12. Indemnification

  • You agree to indemnify, defend, and hold harmless The Bunker and its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from or related to your breach of these Terms, your User Content, or your violation of any law or rights of a third party.

13. Changes to These Terms

  • We may modify these Terms from time to time. If we make material changes, we will provide notice (for example, via in-app notification or email) and obtain consent where required by law.
  • Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

14. Governing Law and Dispute Resolution

17. Children’s Privacy

  • The Service is not directed to children under 13. If you are a parent or guardian and believe The Bunker has collected personal information from a child under 13, contact us and we will take steps to remove such information.

18. Miscellaneous

  • These Terms constitute the entire agreement between you and The Bunker regarding the Service and supersede any prior agreements.
  • If any provision is held to be unenforceable, the remaining provisions will remain in full force and effect.
